Terms of Service

Overview

These Terms of Service (“Terms”) govern your use of the Kayba website (kayba.ai), hosted dashboard (app.kayba.ai), and related services. By using our services, you agree to these Terms.

License to Use

Subject to these Terms, Kayba grants you a limited, non-exclusive, revocable, non-transferable license to access and use the hosted services (dashboard). This license does not include any right to sublicense, resell, or distribute the services.

Open Source License

The Kayba framework is released under the MIT License. Your use of the open-source framework is governed by that license, which is separate from these Terms. These Terms apply specifically to the hosted services and website.

Intellectual Property

Kayba owns all rights, title, and interest in and to the platform, service, and website content, including all associated intellectual property rights. Users retain full ownership of their data, conversation traces, and extracted skills.

User Content

You are solely responsible for the content of conversation traces and data you upload to the platform. You must ensure you have the right to upload such content and that it does not contain sensitive personal information without appropriate authorization.

Paid Services

  • Subscription-based pricing is as displayed on the website at the time of purchase.
  • Subscriptions auto-renew unless cancelled before the end of the current billing period.
  • You may cancel at any time; access continues until the end of the billing period.
  • Refunds are provided at Kayba's discretion.

Prohibited Uses

You agree not to:

  • Misuse the service or use it in a manner that disrupts others.
  • Attempt to compromise the security or integrity of our systems.
  • Use the service for any illegal purpose.
  • Reverse engineer the hosted platform. Note: the open-source framework is MIT licensed and may be freely modified.

Warranty Disclaimer

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KAYBA'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO KAYBA IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify and hold harmless Kayba and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the services or violation of these Terms.

Governing Law

These Terms are governed by the laws of Switzerland. Any disputes shall be resolved in the courts of Zurich, Switzerland.
